Title XXVIII

National Defence and Wartime Governance Act 2025 (NDWG)

The official text of the National Defence and Wartime Governance Act 2025 (NDWG).

Article 1

Definitions

Preamble:

To safeguard the sovereignty, territorial integrity, and constitutional order of Links Land against all forms of warfare, and to ensure the continuity of governance, protection of citizens, and preservation of freedoms during existential threats, in accordance with Chapter 1 (Sovereignty), Chapter 2 (Monarchy), and Chapter 6 (Fundamental Rights) of the Constitution.

Section 1A -- Types of War

Declared War: Formal declaration by Parliament against a foreign state or coalition.

Undeclared Armed Conflict: Hostilities without formal declaration (e.g., cyberattacks, proxy wars).

Civil War: Armed insurrection against constitutional authority.

Hybrid War: Combined kinetic, cyber, economic, and informational aggression.

Section 1B -- States of Emergency

State of National Defense (SND): Activated during foreign invasion or declared war.

State of Internal Defense (SID): Activated during civil war or insurrection.

State of Total Mobilization (STM): Full societal and economic mobilization for existential threats.

Article 2

Delegation of War Powers

Section 2A -- Monarch's Role

The Monarch remains symbolic Commander-in-Chief but delegates operational authority to the National Defense Council (NDC), chaired by the President..

HM may address the nation weekly to uphold morale but holds no tactical authority.

Section 2B -- Parliamentary Authority

Declaration of War: Requires 2/3 majority in both the Chamber of Commons and Royal Council Hall.

Emergency Powers: Parliament may suspend non-essential constitutional clauses (e.g., term limits) with 3/4 majority during STM.

Section 2C -- National Defense Council (NDC)

Composition:President, Defense Minister, Chief of Defense Staff, and Opposition Leader.

Powers:

Direct military operations.

Impose curfews, conscription, and rationing.

Suspend international treaties temporarily.

Article 3

Public Protocols

Section 3A -- Civilian Mobilization

Conscription:

All citizens aged 18--45 subject to draft during SND/STM.

Exemptions for critical workers (healthcare, utilities).

Curfews: Enforced from dusk to dawn in conflict zones.

Section 3B -- Resource Management

Rationing: Food, fuel, and medical supplies distributed via national ID-linked quotas.

Nationalization: Private industries (energy, transport) temporarily state-controlled.

Section 3C -- Information Control

Media Censorship: False reporting or demoralizing content punishable by High Offence (10 years imprisonment).

Disinformation Response Unit: Neutralizes foreign propaganda and coordinates public messaging.

Economic Measures

Section 4A -- War Economy

Asset Freezes: Foreign holdings of hostile entities seized.

War Bonds: Citizens required to invest 5% of income into national defense.

Price Controls: Essential goods capped at pre-war prices.

Section 4B -- Critical Infrastructure

Cyber Defense Mandate: All telecom and energy firms adopt military-grade encryption.

Sabotage Penalties: Tampering with infrastructure punishable by Death Penalty (if constitutional).

Rights and Freedoms

Section 5A -- Suspension of Rights

Article 7

Constitutional Compliance (Article C)

Section 7A -- Authority

War powers derive from Chapter 1, Article 2 (defense of sovereignty) and Chapter 4, Article 12 (parliamentary authority).

Rights suspensions comply with Chapter 6, Article 16(4) (proportionality).

Section 7B -- Monarch's Safeguard

HM may dissolve the NDC and restore civilian rule if it violates Chapter 2, Article 6 (constitutional monarchy).

Article 8

Examples of Protocol Activation

Foreign Invasion (SND):

Full conscription, media blackout, and border closures.

Cyberwarfare (Hybrid War):

Mandatory VPN use, critical infrastructure guarded by military.

Insurrection (SID):

Suspension of habeas corpus in rebel-held regions.

Penalties for Wartime Crimes

Treason: Aiding enemies -- Death Penalty or life imprisonment.

Desertion: High Offence (20 years imprisonment).

Looting: Low Offence (5 years imprisonment + restitution).

Final Provision:

This Act shall supersede all conflicting statutes during active warfare but expire automatically two years after conflict cessation, unless renewed by Parliament.

Enactment:

By the solemn duty of the Crown and the will of the people, this Act is hereby enshrined as the shield of our nation.
