Civil Proceedings Act 2025

The official text of the Civil Proceedings Act 2025.

Article 1

Jurisdiction of Civil Courts

Preamble:

To govern civil litigation in the Constitutional Monarchy of Links Land, ensuring equitable resolution of disputes per the Constitution (Chapter 5, Article 14).

Section 1A -- High Chancery Court of Equity

(a) Hears civil claims exceeding 500,000 Links Landic Dimes (e.g., property disputes, corporate contracts).

(b) May issue injunctions or declaratory judgments.

Section 1B -- Civil Claims Tribunal

(a) Adjudicates claims ≤500,000 Links Landic Dimes (e.g., debts, leases).

(b) Simplified procedures; no jury trials.

Section 1C -- Specialized Civil Courts

(a) Royal Family Bench: Divorce, custody, inheritance.

(b) Commerce Arbitration Panel: Corporate disputes, bankruptcy.

(c) Environmental Stewardship Court: Land-use or pollution cases.

Article 2

Commencing Proceedings

Section 2A -- Filing Requirements

(a) Claims must specify jurisdiction (e.g., High Chancery Court, Civil Claims Tribunal).

(b) Improperly filed claims are dismissed or transferred within 14 days.

Section 2B -- Counterclaims

(a) Defendants may file counterclaims within 30 days of service.

(b) Mandatory mediation (Article 3A) supports Chapter 6, Article 16(4) ("Right to resolve disputes fairly").

Section C3 -- Enforcement of Rights

(a) Monetary judgments (Article 4A) and contempt penalties (Article 4B) uphold Chapter 6, Article 16(4) ("Right to effective remedy").

(b) Special protections for vulnerable parties (e.g., family law in the Royal Family Bench) comply with Chapter 6, Article 16(1) ("Right to family life").

Section C4 -- Constitutional Review

(a) Final appeals to the Crown Sovereign Court (Article 5B) fulfill Chapter 5, Article 15(1) (Constitutional Court's duty to review legality).
